The State Administration for Market Regulation, the National Health Commission, and the State Administration of Traditional Chinese Medicine recently jointly released the "List of Non Nutrient Supplements that Allow Health Food Claims (2023 Edition)" (hereinafter referred to as the "List") and supporting documents, standardizing the management of health function claims, implementing the main responsibilities of enterprise health function claims and research and development evaluation, and promoting industrial innovation and high-quality development. To ensure the smooth and orderly implementation of the Catalogue, the State Administration for Market Regulation promptly formulated supporting interpretations and adopted a scientific and dynamic management model of "government releases mature catalogs, enterprise research and innovation supplements", organically combining the development of functional catalogs with the application of new functions, systematic planning, and coordinated promotion. We have mainly carried out three aspects of reform and innovation: first, scientific positioning and standardized claims. The health function claims to avoid confusion with the therapeutic effects of drugs and diseases, and to block false advertising loopholes. For example, adjust the original "auxiliary blood pressure lowering" to "help maintain a healthy level of blood pressure". The statement of health function claims should be more scientific and rigorous, easy to understand, scientifically recognized by consumers, and avoid absolute statements that are easily misled and misunderstood. For example, adjusting the original "increase in bone density" to "help improve bone density"; Adjust 'weight loss' to' help control body fat '. The second is to steadily promote and dynamically manage. Based on existing functions and regulatory positioning, adopt a "mature batch, integrated batch" model for healthcare functions approved in different historical periods. Reform the "nanny style" functional management model, change the supporting functional evaluation methods from mandatory methods to recommended methods, and encourage enterprises and diverse social entities to propose new functional suggestions and new functional evaluation methods. The third is a smooth transition and orderly connection. At the policy level, for those that have been approved in history but have not yet been included in the health function catalog, a 5-year transition period will be established to allow enterprises to apply for the inclusion of corresponding health functions in the health function catalog based on relevant research.
