Several departments in Shanghai recently issued the "Implementation Measures for the Supervision of Prepaid Consumption Business Activities in the Sports and Fitness Industry in Shanghai (Trial)", which will come into effect on March 1st this year. This method proposes regulatory measures for prepaid consumption business activities in the industry, establishing for the first time the limit, deadline, and limit standards for prepaid funds in the sports and fitness industry. Article 8 of the Implementation Measures stipulates that operators shall not collect membership prepayments from the same consumer in a lump sum or in a disguised form, with an amount exceeding 5000 yuan and a duration exceeding 24 months; Prepayments for class hours exceeding 20000 yuan and more than 60 times; Prepayments such as stored value exceeding 5000 yuan. The total amount of prepaid vouchers collected by the operator from the same consumer shall not exceed 20000 yuan. After renewing the contract between the operator and the consumer, the amount of prepaid funds collected from the same consumer, as well as the corresponding service period and frequency, shall not exceed the provisions of the preceding paragraph. Yu Jian, Deputy Director of the Planning Industry (Regulations) Department of the Shanghai Sports Bureau, stated that promoting the implementation of the "three restrictions" regulations is to encourage operators to reasonably set the scale of advance receipts, strengthen operational risk control, avoid blind expansion and excessive competition, and return from "sales orientation" to "service priority". In the long run, after the trial implementation of the document, the "three limits" standard can be adjusted in a timely manner according to the actual situation of the industry. The implementation measures also require that through business publicity and written notification, the focus should be on highlighting the content that consumers are prone to overlook and complaints and disputes may arise afterwards, and warning consumers of the risk of advance payment. Sun Chong, Secretary General of the Shanghai Fitness and Bodybuilding Association, introduced: "In the disclosure of business information, based on the characteristics of the industry, emphasis is placed on publicizing the lease term of the operating premises to prevent operators from issuing membership cards beyond the lease term, and the fee standards are publicized to promote the implementation of clear pricing in the industry. At the same time, the implementation measures specify and list the contents that have significant interests with consumers to ensure that consumers know and recognize them." The measures also emphasize that operators should enter into a written contract with consumers and link it with the written notification requirements stipulated in the Shanghai Sports Development Regulations, clearly establish a contract model text that specifies the content of the written notification, which is regarded as fulfilling the obligation of written notification, and further promote the use of contract model texts. At the same time, the implementation measures stipulate that if operators in the sports and fitness industry fail to fulfill their written notification obligations as required, or fail to set advance payment amounts and redeemable service periods and times in accordance with regulations, they shall be punished in accordance with Article 67 of the Shanghai Sports Development Regulations. If the operator violates the regulations by failing to connect and submit relevant information, or fails to take risk prevention measures related to advance receipts in accordance with the regulations, they shall be investigated and dealt with in accordance with Article 26 of the Shanghai Single purpose Prepaid Consumer Card Management Regulations.
