Promoting better transformation of scientific and technological achievements through the rule of law

Technology is the primary productive force, and protecting intellectual property is protecting innovation. We must adhere to the rule of law and continuously improve the innovative achievement transformation and application system that is in line with the development of new technologies. At the press conference held by the New Office of the State Council on April 24, the Director of the China National Intellectual Property Administration introduced the main progress in building China into an intellectual property power in the past year, and mentioned that in the 2023 Global Innovation Index Report released by the World Intellectual Property Organization, the number of China's top 100 scientific and technological clusters in the world reached 24, ranking first in the world for the first time. This fully demonstrates that China has excellent technological innovation capabilities. Technological innovation can give birth to new industries, new models, and new driving forces, which are the core elements for developing new quality productive forces. Intellectual property is the bridge and link that enables technological achievements to be transformed into real productive forces. Technological innovation cannot be separated from legal guarantees such as intellectual property legal system. In recent years, China has continuously improved its legal system related to scientific and technological innovation. Firstly, with the Law on Scientific and Technological Progress, the Law on Promoting the Transformation of Scientific and Technological Achievements, and the Law on Science and Technology Popularization as the core laws, China has provided comprehensive guarantees for scientific and technological innovation from multiple aspects such as policy guidance, allocation of scientific research resources, scientific and technological cooperation, achievement transformation, cultivation of scientific and technological talents, and innovation environment. Especially the revised Science and Technology Progress Law in 2021 effectively implements the decision-making and deployment of the Party Central Committee on scientific and technological innovation, strengthens the layout of the national innovation system, clarifies key core technological goals, and lays a solid legal foundation for the development of scientific and technological innovation. It is a significant progress in the construction of the rule of law for scientific and technological innovation in China. Secondly, in response to technological innovation achievements, China has continuously improved and refined its intellectual property legal protection system, forming an intellectual property protection system supported by laws and regulations such as the Patent Law, Copyright Law, Computer Software Protection Regulations, Integrated Circuit Layout Design Protection Regulations, and Plant New Varieties Protection Regulations, in order to consolidate the legal foundation for promoting innovation. In addition, in the face of the rapid development of emerging cutting-edge technologies and industries, China has also made advance arrangements from a legal perspective on the risks and ethical issues that may arise from technological innovation. Special legislative work has been carried out in basic research and major strategic areas, and laws and regulations such as the Biosafety Law, the Regulations on the Management of Human Genetic Resources, the Data Security Law, and the Interim Measures for the Management and Service of Generative Artificial Intelligence have been successively introduced to ensure that technological innovation in cutting-edge fields develops on a safe track. It can be said that under the guarantee of the rule of law, China has continuously made new breakthroughs in scientific and technological innovation. Over the past year, the construction of the national laboratory system has been vigorously promoted. The achievements in key core technology research and development have been fruitful, with significant progress made in the development of high-end equipment such as aviation engines, gas turbines, and fourth generation nuclear power units. Innovative achievements in cutting-edge fields such as artificial intelligence and quantum technology continue to emerge. The transaction volume of technology contracts increased by 28.6%. The ability to drive development through innovation continues to improve. Data shows that in 2023, China granted 921000 invention patents, a year-on-year increase of 15.3%. The registration volume of works and computer software copyrights reached 6.428 million and 2.495 million, respectively, with a year-on-year increase of 42.3% and 36%...
