The State Council Information Office Holds a Press Conference on the Improvement of China's Intellectual Property Dispute Mediation System

On the morning of April 24th, the State Council Information Office held a press conference to introduce the relevant situation of building a strong intellectual property country in China in 2023. Relevant officials from the China National Intellectual Property Administration, the Central Propaganda Department and the State Administration of Market Supervision attended the press conference and answered questions from reporters. The press conference introduced that in 2023, China's intellectual property protection work will become more effective. The construction of the first batch of 10 national intellectual property protection demonstration zones has achieved initial results, and the selection of the second batch of 15 has been completed. There are a total of 112 national level intellectual property protection centers and rapid rights protection centers. Throughout the year, 44000 cases of patent and trademark violations were investigated, 68000 administrative cases of patent infringement disputes were handled, and 4745 cases of copyright infringement and piracy were investigated. 62000 batches of suspected import and export infringement goods were seized, and 19000 intellectual property customs protection records were approved. 490000 intellectual property cases have been concluded. We have reviewed and prosecuted 31000 people for intellectual property infringement crimes, and handled over 2500 cases of civil and administrative litigation supervision for intellectual property. Detected 40000 cases of intellectual property infringement and the production and sale of counterfeit goods. Social satisfaction with intellectual property protection has increased to 82.04 points, reaching a new high. Strengthening the mediation of disputes in the field of intellectual property is an important part of deepening the construction of a diversified mechanism for resolving conflicts and disputes, and also an important link in strengthening the full chain protection of intellectual property. According to the press conference, in recent years, China's level of diversified resolution and specialization in intellectual property disputes has continued to improve. As of now, there are 2000 mediation organizations guided and managed by the national intellectual property system. In the first quarter of this year, the number of mediation cases accepted reached 26000, a year-on-year increase of 27.7%, effectively expanding the channels for resolving intellectual property disputes. The China National Intellectual Property Administration and the Supreme People's Court cooperated to promote the construction of online dispute litigation and mediation docking mechanism, and the "total to total" online litigation and mediation docking in the field of intellectual property achieved full coverage of 31 provinces (districts, cities) and Xinjiang Production and Construction Corps. As of now, 648 intellectual property dispute mediation organizations and 5095 mediators have settled on the People's Court Mediation Platform, with a success rate of nearly 80% in case mediation pushed by the platform. In terms of copyright dispute mediation, from 2018 to 2023, people's courts at all levels across the country received 2.5767 million new first instance cases of intellectual property, of which 1.7225 million were copyright cases, accounting for approximately 66.8% of intellectual property cases. Recently, the Central Propaganda Department (National Copyright Administration) and the Supreme People's Court jointly issued a notice on establishing an online litigation and mediation mechanism for copyright disputes, jointly establishing and improving the governance of copyright dispute sources and diversified resolution mechanisms, fully leveraging the guidance and coordination role of copyright management departments, the guidance and protection role of people's courts, and the professional mediation role of relevant organizations, strengthening the awareness of the people and market entities to resolve copyright disputes through mediation, protecting the legitimate rights and interests of relevant rights holders in accordance with the law, and shaping a good business environment.
