On the 16th, the Supreme People's Court reported on the work of the people's courts in safeguarding the legitimate rights and interests of women and children in accordance with the law. It is reported that the situation of juvenile delinquency remains severe, and the issue of campus violence cannot be ignored. Data shows that in the past three years, the overall number of juvenile delinquency has been on the rise. From 2021 to 2023, people's courts have concluded a total of 73178 cases of juvenile delinquency and sentenced 98426 juvenile offenders, accounting for 2% to 2.5% of all criminal offenders during the same period. Criminal acts against women and children are on the rise, and the issue of sexual abuse against women and children cannot be ignored. In 2023, courts across the country concluded 41000 cases and 61000 cases of crimes against minors, and the phenomenon of minors being harmed by family members was severe. The problem of cybercrime is prominent, and the erosion of harmful information on the internet cannot be ignored. It is reported that nearly 60% of minors who commit crimes such as robbery, theft, and violent injury have been addicted to the internet for a long time. The proportion of minors who are influenced by harmful information on the internet and have criminal motives is relatively high. The problem of lack of family guardianship is prominent, and the impact of family care on juvenile delinquency cannot be ignored. According to judicial big data, from 2021 to 2023, there were a total of 1835 cases of violence involving minors concluded in the first instance by courts nationwide, with defendants being left behind children, accounting for 22.94%; There are a total of 556 cases where the defendant is from a single parent family, accounting for 6.95%; There are a total of 223 cases where the defendant is from a remarried family, accounting for 2.79%; There are a total of 19 cases where the defendant is an orphan, accounting for 0.24%. Many underage defendants lacked family care and education before committing crimes. It is reported that the people's courts adhere to the policy of "education, persuasion, and rescue" and the principle of "education as the main focus, punishment as the auxiliary" in dealing with juvenile delinquency. They actively adopt trial methods that are suitable for the physical and mental characteristics of minors, emphasizing that trial should not only serve as a public hall for punishing minors who have committed crimes, but also as a classroom for rescue education. Recently, the discussion on criminal responsibility for murder and serious injury committed by minors aged 12 but not 14 has attracted widespread attention. As of now, the People's Court has concluded a total of 4 such cases and 4 individuals. The criminals are between the ages of 12 and 13 and have been sentenced to 10 to 15 years imprisonment in accordance with the law. The person in charge of the Supreme People's Court stated that the appearance of problematic children is due to both family and social reasons, and is the result of a combination of multiple factors. In the trial of cases such as marriage and family matters, infringement, etc., attention should be paid to strengthening guardianship responsibilities and educational guidance work, guiding parents to fulfill their guardianship responsibilities in accordance with the law.
