3227 public interest litigation cases in the field of national defense and military interest protection have been handled, and the 2024 Work Plan for Military Civilian Collaborative Handling of Prosecutorial Public Interest Litigation has been issued

On the morning of April 17th, the National Public Interest Litigation Procuratorate Military Civilian Cooperation Work Conference was held in Hengyang City, Hunan Province. At the meeting, Xu Xiangchun, Director of the Eighth Procuratorate of the Supreme People's Procuratorate, reported on the work of military civilian cooperation in public interest litigation nationwide. The meeting issued the "2024 Work Plan for Military Civilian Cooperation in Public Interest Litigation". It is reported that in April 2020, the Supreme People's Procuratorate and the Political and Legal Affairs Commission of the Central Military Commission jointly issued the "Opinions on Strengthening the Cooperation between Military and Civilian Prosecutors in Public Interest Litigation". In recent years, with the collaborative efforts of military and civilian procuratorial organs, the number of cases handled has steadily increased, the scope of cases has continued to expand, and the quality and efficiency of cases have continuously improved. A total of 3227 public interest litigation cases in the fields of national defense and military interest protection have been filed and handled. The military and civilian procuratorial organs jointly handled 1295 cases, including 1276 administrative public interest litigation cases and 19 civil public interest litigation cases. Military and civilian procuratorial organs have always been centered on handling cases, focusing on key areas of military training and preparation, highlighting prominent issues strongly reflected by military officers and soldiers, fully leveraging the effectiveness of the procuratorial public interest litigation system, and continuously expanding the scope of procuratorial organs in handling cases. From the perspective of case handling, it has gradually expanded from traditional legal fields such as state-owned property protection and ecological environment protection related to the military to new areas where military security and facilities protection, military land protection, military training security, national defense education and other national defense military elements are more prominent. From the perspective of case types, it has expanded from civil public interest litigation for the protection of the reputation of martyrs to administrative public interest litigation for the protection of martyr memorial facilities. From the perspective of public welfare, in handling cases, more emphasis is placed on preventive protection, promoting the governance of litigation sources and front-end governance, which is more in line with the protection needs of national defense and military interests as special public welfare. In April 2021, the Supreme People's Procuratorate, together with the Military Procuratorate of the People's Liberation Army and relevant departments of the Air Force, jointly launched a special public interest lawsuit on air force airport clearance protection. In addition, various coastal procuratorial organs carried out a special operation on "sea purification" and achieved outstanding results. Consensus was reached on strengthening military civilian cooperation, coordinating local cases, and systematically promoting problem resolution. Military and civilian procuratorial organs have also increased their efforts to protect military facilities, civil defense facilities, and other facilities. Based on local characteristics, various regions have carried out special projects for the protection of military oil and gas pipelines, transmission lines, national defense optical cables, military training grounds, and other military facilities, as well as for the protection of civil defense projects. We will continuously increase our efforts in protecting the legitimate rights and interests of military personnel and their families, as well as protecting military related red resources. We will use the "procuratorial blue" to safeguard the "olive green". It is understood that military and civilian procuratorial organs actively build mechanisms for collaborative case handling and cooperation in various levels and fields, jointly hold more than 3000 joint meetings, hearings, and symposiums, and carry out 110 joint special actions. Various regions actively explore and form a standardized system for case handling that is in line with local characteristics and practical work. The meeting also issued the "2024 Work Plan for Military Civilian Collaborative Handling of Public Interest Litigation in Prosecutors", further deepening the cooperation between military and civilian prosecutors, and effectively improving the quality and efficiency of public interest litigation in national defense and military fields.
