Vice Minister of Justice Wang Zhenjiang stated at a press conference of the State Council Information Office today that the Ministry of Justice will implement the relevant requirements of the Private Economy Promotion Law, continue to regulate administrative law enforcement behavior, resolutely curb profit driven law enforcement, and effectively protect the legitimate rights and interests of private economic organizations and their operators in accordance with the law. Wang Zhenjiang introduced that since the 18th National Congress of the Communist Party of China, the Party Central Committee and the State Council have made a series of decisions and deployments to strengthen and improve administrative law enforcement work, requiring the comprehensive promotion of strict, standardized, fair and civilized law enforcement. In the process of formulating the Law on the Promotion of the Private Economy, we have resolutely implemented the above decision-making arrangements. In response to the strong reflection of various law enforcement chaos such as arbitrary fees, fines, inspections, seizures, illegal law enforcement in different places, and profit seeking law enforcement in some places and departments, the Law on the Promotion of the Private Economy has made clear provisions: to establish and improve the mechanism for handling complaints and reports of administrative law enforcement violations, the mechanism for communicating administrative law enforcement demands related to enterprises, and to strengthen supervision of administrative law enforcement activities. "Wang Zhenjiang emphasized that in the next step, the Ministry of Justice will implement the relevant requirements of the Law on the Promotion of the Private Economy, continue to regulate administrative law enforcement behavior, and focus on three aspects of work: first, to implement legal requirements and accelerate the construction of legal supporting systems and mechanisms. Promote the establishment and improvement of a mechanism for handling complaints and reports of administrative law enforcement violations, and promptly accept and handle complaints and reports related to enterprise administrative law enforcement in accordance with the law. Judicial administrative organs shall establish contact points for administrative law enforcement supervision of enterprises, and promptly listen to the opinions and suggestions of various business entities on enterprise related administrative law enforcement. Promote the system of administrative law enforcement supervisors and invite representatives of the National People's Congress, members of the Chinese People's Political Consultative Conference, people's supervisors, experts and scholars, lawyers, journalists, and others to participate in supervision. The second is to take the lead in carrying out a special action to standardize administrative law enforcement related to enterprises. Last year, the Central Economic Work Conference proposed to launch a special action to standardize law enforcement related to enterprises. On April 25th of this year, the Central Politburo meeting once again emphasized the need to carry out a solid special action to regulate law enforcement related to enterprises. The Ministry of Justice, as the administrative law enforcement supervision agency of the State Council, is responsible for coordinating and organizing national special actions for regulating enterprise related administrative law enforcement. Local judicial administrative agencies at all levels, as the administrative law enforcement supervision agencies of their respective governments, are responsible for organizing and implementing special actions in their respective regions. The Ministry of Justice will resolutely implement the decisions and arrangements of the Party Central Committee and the State Council, take the implementation of the Private Economy Promotion Law as an opportunity, urge all regions and departments to increase their efforts in investigating and punishing administrative law enforcement violations, strengthen problem investigation and rectification, and resolutely rectify them. At the same time, spot checks will be conducted on key areas, key fields, and key issues to evaluate and analyze the effectiveness of rectification in stages. For problems strongly reflected by enterprises and the public, if necessary, they will be upgraded and handled, and those who fail to rectify will be supervised; Timely promote and exchange good experience and practices formed in work; Those who fail to carry out effective rectification work will be interviewed, reported, and exposed according to the situation. The third is to accelerate the research and formulation of administrative law enforcement supervision regulations, and establish and improve a long-term mechanism for enterprise related administrative law enforcement supervision. The Ministry of Justice will take the implementation of the requirements of the Private Economy Promotion Law as the starting point, and focus on establishing and improving a long-term mechanism for administrative law enforcement supervision related to enterprises. Urgently study and draft the Regulations on Administrative Law Enforcement Supervision. To address common issues in administrative law enforcement, we will further improve the supervision system, procedures, and responsibility system for administrative law enforcement, providing solid legal guarantees and institutional support for strengthening administrative law enforcement supervision, regulating administrative law enforcement behavior, and protecting the legitimate rights and interests of various business entities, including private economic organizations, in accordance with the law.
