It is reported that the "Regulations on Fair Competition Review" came into effect in August last year, which clearly requires the drafting of laws, administrative regulations, local regulations, rules, normative documents, and specific policy measures related to the economic activities of operators to carry out fair competition review. The implementation measures introduced this time aim to refine the relevant provisions and measures of the regulations. There are a total of 48 implementation measures. In terms of refining the review standards, the implementation measures have refined the review standards for the four aspects of restricting or indirectly restricting market access and exit, restricting the free flow of commodity factors, affecting production and operation costs, and affecting production and operation behavior stipulated in the regulations into 66 specific situations, which is convenient for market supervision departments at all levels and policy drafting units to accurately understand and standardize their application; Clarify the meaning of concepts such as "no alternative solution with less impact on fair competition" and "reasonable implementation period" in the exception provisions to prevent their abuse and harm to market competition. In terms of improving the review mechanism, the implementation measures put forward specific requirements for the drafting unit to carry out fair competition review procedures and contents, clarify the ways and scope of listening to the opinions of stakeholders, etc; Refine the policy measures and work procedures for conducting fair competition review by the market supervision department in conjunction with the drafting unit. The State Administration for Market Regulation stated that it will actively deploy and carry out actions to enhance the ability of fair competition review, strictly carry out policy measures for fair competition review, and stop various regulations and practices that hinder the unified national market and fair competition from the source.
