Standardize the market and make second-hand car transactions more reassuring

2024-05-13

With the continuous expansion of China's automobile trading scale, the proportion of second-hand car trading in automobile trading is increasing. According to statistical data released by the China Association of Automobile Dealers, in 2023, the cumulative transaction volume of second-hand cars in China was 18.4133 million, a year-on-year increase of 14.88%, and the cumulative transaction amount reached 1179.532 billion yuan. However, while the second-hand car market is thriving and developing, it has also exposed some problems, such as concealing the condition of vehicles, exaggerating publicity, providing arbitrary quotes, and irregular transactions, which disrupt the order of the second-hand car trading market and infringe on the legitimate rights and interests of consumers. Not long ago, Mr. Song from Wuhu City, Anhui Province, left a message on the "People's Complaints" platform on People's Daily that in November 2023, he spent 43000 yuan to purchase a used car, only to find out that it was an accident car after picking it up. However, the merchant concealed the condition of the vehicle. "When buying the car, the merchant informed me that it was original paint with only a few minor scratches. However, I later discovered that this car had a major accident in 2020, with 20 repair and replacement items." Mr. Song said, "At the time of delivery, I also found that the vehicle had multiple problems such as engine hood depression, deformation of the right front fender frame, and cracking of the water tank frame. However, the merchant repeatedly emphasized that these were minor issues that did not affect the vehicle's use and were unwilling to bear the cost of replacement and repair." In second-hand car transactions, many consumers have encountered similar situations. ". "According to the Law on the Protection of Consumers' Rights and Interests, second-hand car dealers should comprehensively check and test important information such as whether the source of the car they sell is legal, mileage, maintenance records, transaction records, and problems with the vehicle before selling, and inform consumers of the test results in writing or in other ways that can be confirmed." Lu Enxiang, a lawyer from Beijing Yuandong Law Firm, said, "If knowing that the car is an accident car and deliberately concealing the facts to induce consumers to buy it, it may constitute fraud. According to the relevant provisions of the Law on the Protection of Consumers' Rights and Interests, consumers have the right to claim a refund of one compensation for three." In second-hand car transactions, adjusting the odometer is also one of the problems that consumers reflect more intensively. Mr. Li from Rizhao City, Shandong Province, ordered a second-hand car online and confirmed with the seller over the phone that it had a mileage of over 90000 kilometers, with no accidents, fires, or water bubbles, and guaranteed that it could be included in the contract. But when Mr. Li went to the site to handle the procedures, he found that the actual odometer showed only over 50000 kilometers. "This is a car from 2010, which has been transferred three times and has a mileage of only over 50000 kilometers. Is this possible?" Mr. Li expressed doubts about this. It is understood that due to the direct impact of the service life and mileage of cars on second-hand car prices, some businesses adjust their odometers to attract customers. "In the market, cars that have been in use for less than 5 years and have a mileage of less than 50000 kilometers are quite popular. For some cars that have been transferred multiple times and have a long service life, some businesses will make plans on the odometer to significantly reduce the mileage to attract customers," said an industry insider. In addition, due to the lack of professional identification ability among consumers, some flooded and faulty vehicles may also be sold to them by car dealers as vehicles in good condition. Some second-hand car dealers have concerns about the exterior of their vehicles
