On December 1, the sales of psychotropic drugs and traditional Chinese medicine formula granules will be banned. The Measures for the Supervision and Administration of Drug Online Sales (hereinafter referred to as the Measures), China's regulatory measures for online drug sales, have been officially implemented. Online drug sales will have laws and regulations to follow, and truly usher in the era of strong supervision. According to the previous Prohibited List of Drug Online Sales (Draft for Comments), vaccines, blood products, narcotic drugs, psychotropic substances, toxic drugs for medical use, radioactive drugs, pharmaceutical precursor chemicals, preparations of medical institutions and traditional Chinese medicine formula granules are explicitly prohibited from online sales of drugs by policies and regulations. Other drugs prohibited from retail through the Internet, including injections (except for hypoglycemic drugs), compound preparations containing ephedrine (excluding Chinese patent medicines containing ephedra), and varieties with high risk of drug use, are prohibited from selling through the Internet. Xu Jinghe, a member of the Party Leadership Group and Deputy Director of the State Food and Drug Administration, said that with the continuous in-depth development of the Internet, "Internet plus" has fostered and expedited the emergence of the new business form of online drug sales, which has played an important role in cultivating new business models, enabling retail enterprises, and facilitating mass purchase of drugs. At the same time, we are soberly aware that the Internet has broken the time and space constraints, expanded the associated subjects, extended the chain of responsibility, brought new challenges to social governance, and the problem of online drug sales has occurred frequently. The insiders pointed out that the Measures revealed that the regulatory attitude tended to be strict and standardized, and at the same time, they followed the "principle of consistency between online and offline" of business supervision, and made more strict and specific provisions on the separate display of online prescription drugs, prescription before drug, and ensuring the authenticity of prescriptions. The demand for online drug sales has increased, and the regulatory risk has surged. In recent years, all links of the pharmaceutical industry chain have been integrated online and offline. With the improvement of third-party service supporting capabilities such as logistics distribution, the growth of online drug retail terminals has increased significantly. According to the data provided by the Southern Institute of Pharmaceutical Economics of the State Food and Drug Administration, although the growth rate of online sales of pharmaceutical retail will slow down in 2021, it is still the highest among the four terminals. It is estimated that the annual sales in 2022 will be 289.9 billion yuan, with a growth rate of more than 32%. The industry will continue to maintain a rapid growth. Among them, with the continuous liberalization of online sales of prescription drugs and medical insurance payment, online purchase of prescription drugs has gradually increased. According to the sales data of more than 200 pharmacies on Tmall and JD platforms, from January to July 2022, the sales of online prescriptions reached 14.47 billion yuan, up 48.9% year on year. "Internet sales are characterized by virtuality, concealment, divergence, and cross region. In particular, there are many types of subjects in drug online sales, different types of subjects have different risks, and different management methods, which pose challenges to supervision and management, law enforcement jurisdiction, case investigation, evidence fixation and other regulatory behaviors." Guo Changmao, deputy director of the Southern Institute of Pharmaceutical Economics of the State Food and Drug Administration, said that Internet information regulation is a worldwide problem, and illegal cases have gradually shifted from offline to online, which has increased drug safety risks while improving people's livelihood.
