In the case, Lao Liu had two sons. After his wife died, the younger son took care of Lao Liu, while the older son seldom took care of Lao Liu. Lao Liu intended to leave his property to his youngest son, so he asked his neighbor to write a will on his behalf. The neighbor and the youngest son signed and sealed the will as witnesses. After the death of Lao Liu, the two sons had a dispute over inheritance. The eldest son believed that the witness of the will was not in accordance with the law and claimed that the will was invalid. So, can children be witnesses of their parents' wills? It can't be explained by case. Article 1140 of the Civil Code stipulates that the following persons cannot be witnesses of a will: (1) persons without civil capacity, persons with limited civil capacity and other persons without the capacity to witness; (2) Successors and legatees; (3) A person who has an interest in a successor or legatee.
