Symposium on Data Protection and Anti Unfair Competition Law Amendment held in Beijing

On March 22nd, a symposium on amending the Data Protection and Anti Unfair Competition Law was held in Beijing. The conference was hosted by the China Institute of Applied Law and hosted by the Internet Justice Research Center of the Institute of Law. More than 20 people, including frontline judges from Beijing Higher People's Court, Tianjin First Intermediate People's Court, Guangzhou Intellectual Property Court, Ningbo Intermediate People's Court in Zhejiang Province, Haidian District People's Court in Beijing, Pudong New Area People's Court in Shanghai, Yuhang District People's Court in Hangzhou City, Zhejiang Province, as well as experts and scholars from research institutions such as Peking University, Renmin University of China, Chinese Academy of Social Sciences, China University of Political Science and Law, Shanghai Jiao Tong University, and relevant enterprise representatives, attended the meeting. The representatives at the meeting summarized the application and existing problems of the "General Provisions" (Article 2), "Internet Special Provisions" (Article 20) and other provisions of the current anti unfair competition law in data rights and interests protection cases, in-depth discussed the new "Data Special Provisions" (Article 18) of the Anti unfair Competition Law of the People's Republic of China (Revised Draft for Comments) and put forward relevant suggestions, and discussed new trends, new situations and new problems in data protection fields such as e-commerce data migration. Representatives attending the meeting stated that the Legal Work Committee of the Standing Committee of the National People's Congress has clearly included the revision of the Anti Unfair Competition Law as a key task for this year at the just concluded National People's Congress and Chinese People's Political Consultative Conference. This symposium is timely and hopes to provide reference for the revision of the Law and the protection of data rights and interests. (Lai Xin She)
