2023-09-21

According to the official WeChat message of the State Administration for Market Regulation, the State Administration for Market Regulation has announced the top ten influential events since the implementation of the Anti Unfair Competition Law for thirty years (1993-2023). 1. Anti unfair competition has entered a new strategic height and continues to advance at a high level. The report of the 20th National Congress of the Communist Party of China regards fair competition as the fundamental system of the market economy, makes strategic arrangements, and once again emphasizes the strengthening of anti monopoly and anti unfair competition, pointing out the direction for anti unfair competition work. Anti monopoly determines the level of competition in the market economy, while anti unfair competition determines the basic level and overall quality of market economy competition. Anti monopoly and anti unfair competition jointly constitute the competition legal system in China's socialist market economy system, jointly building an important legal foundation for fair competition policies, providing strong support for maintaining fair competition, building a new development pattern, and building a high standard market system, and safeguarding high-quality development. 2. The foundation of the rule of law against unfair competition has been continuously strengthened. After the promulgation and implementation of the Anti Unfair Competition Law in 1993, it followed the trend of economic and social development with the times and was continuously revised in 2017 and 2019. In 2022, the Anti Unfair Competition Law launched its third revision, laying a solid legal foundation for improving the socialist market economy system and promoting high-quality development. 3. The rules of the anti unfair competition system are constantly improving. Since 1993, several regulations have been issued, including the "Several Provisions on Prohibiting Unfair Competition in the Name, Packaging, and Decoration of Famous Commodities" (1995), the "Several Provisions on Prohibiting Infringement of Trade Secrets" (1995), the "Interim Provisions on Prohibiting Commercial Bribery" (1996), and the "Interim Provisions on Regulating Promotion Activities" (2020), providing strong support for regulatory enforcement. At the same time, the State Administration for Market Regulation grasps the development trend of the digital economy and the network economy, studies and formulates the "Interim Provisions on Anti Unfair Competition Behaviors in the Internet", focuses on clarifying regulatory rules, and regulates various new types of network unfair competition behaviors implemented through technology and algorithms. The law enforcement inspection by the Standing Committee of the National People's Congress is at the right time to promote the fight against unfair competition to a new level. From September to December 2020, the Standing Committee of the National People's Congress conducted an inspection of the implementation of the Anti Unfair Competition Law. This is an important measure taken by the Standing Committee of the National People's Congress to implement the spirit of the Fourth Plenary Session of the 19th Central Committee of the Communist Party of China and the decisions and deployments of the Party Central Committee. Organize law enforcement inspections, comprehensively understand the implementation of the Anti Unfair Competition Law, summarize the effectiveness and experience of legal implementation, and identify existing problems and deficiencies. The law enforcement inspection report further proposes opinions and suggestions on strengthening and improving work, improving the legal system, and clarifying tasks. 5. Consolidate joint efforts, and the important role of departmental coordination mechanisms is becoming increasingly prominent. In November 2020, with the approval of the State Council, an anti unfair competition inter ministerial joint meeting system was established, led by the State Administration for Market Regulation and composed of 17 departments and units including the Central Cyberspace Administration and the Ministry of Education. In terms of top-level design and organizational structure, the anti unfair competition work was elevated to a new level. In 2021, the first plenary session of the Joint Ministerial Conference on Anti Unfair Competition was held
