Protecting Red Memory with the Power of the Rule of Law

Flowers are offered to the martyrs, and mourning is offered to the loyal souls. The Qingming Festival is approaching, and we not only need to remember the martyrs, but also to take practical actions to protect the loyal souls. In recent years, the military procuratorial organs of the Southern Theater Command have integrated "governing the present" and "managing the long term" throughout the entire process of fulfilling their duties, strengthened cooperation between military and civilian procuratorates, promoted the construction of a normalized mechanism for the protection of martyr memorial facilities, strengthened the protection of red resources such as martyr memorial facilities with government power, and promoted the formation of the "Southern Military Inspection Plan" for the protection of martyr memorial facilities through joint governance, construction, and management. Special supervision sparked a wave of protection. On March 30th, prosecutors from the Changsha Military Procuratorate visited the Martyrs Cemetery in Maoyanhe Town, Yongding District, Zhangjiajie City, Hunan Province, to launch a "look back" public interest lawsuit on the protection of martyrs' memorial facilities. At the scene, the prosecutor saw flowers placed in front of the tombstone of the Unknown Martyrs, and occasionally people came to pay their respects. In March 1950, 12 unknown martyrs of the People's Liberation Army made heroic sacrifices in the battle against bandits in Luotaping Township, Yongding District, and were later buried on site in Taiping Village of that township. Due to long-term neglect and worship, the facilities of the Tomb of the Unknown Martyrs are dilapidated and overgrown with weeds. In March 2021, after learning about the current situation of the Tomb of the Unknown Martyrs, the Changsha Military Procuratorate joined forces with the Yongding District Procuratorate to initiate the administrative public interest litigation filing process, issued pre litigation procuratorial recommendations to the Yongding District Veterans Affairs Bureau, and continued to track and understand the implementation of the procuratorial recommendations. After multiple on-site investigations and consultations with the Bureau of Veterans Affairs, the Bureau of Culture, Tourism, Radio, Film and Sports, and the local town government, the relevant departments have decided to relocate the remains of the unknown martyrs to the Martyrs Cemetery in Maoyanhe Town. In April of the same year, under the witness of the military and civilian procuratorial organs, the remains of 12 unknown martyrs were relocated to the Martyrs Cemetery in Maoyanhe Town, with the heroic deeds of the martyrs engraved on the tombstones. Hunan is a revolutionary hotspot with abundant red resources. It is understood that in August 2020, the Changsha Military Procuratorate, in combination with local conditions, deployed the special action of public interest litigation of "Xiaoxiang Red Resources Protection" in conjunction with the Hunan Provincial Procuratorate, the Hunan Provincial Department of Veterans Affairs, and the Hunan Provincial Cultural Heritage Bureau. Over the past two years, procuratorial and police officers have visited many places in the province to search for martyr facilities and red sites, coordinated and carried out protection actions, and promoted the integrity, solemnity, cleanliness, and standardization of martyr memorial facilities. Under the unified deployment of the Military Prosecutors of the Southern Theater Command, the Military Prosecutors of Guangzhou, Nanning, and Kunming have successively carried out special operations to protect martyr memorial facilities. Following the overall approach of "collecting clues by classification, organizing on-site investigations, joint investigation and evidence collection, and promoting problem resolution," a wave of special protection has been sparked. As of March this year, the military procuratorial organs of the Southern Theater Command have handled a total of 115 public interest litigation cases in the field of red resource protection, such as martyr memorial facilities, and supervised the rectification of more than 160 cases. In July 1950, the People's Liberation Army was ordered to carry out a bandit suppression mission in the Yishan area of Guangxi. During the process of suppressing bandits, 45 wounded soldiers sacrificed their lives after ineffective treatment at the former Yishan Kowloon Field Hospital and were buried in the Qingyuan urban area of Yizhou City, Hechi City, including the 18-year-old soldier Wang Daoting. In July 2013, the former Yizhou Municipal Government relocated scattered martyr tombs in the Qingyuan urban area to the Jiulongyan Martyrs Cemetery Group in Qingyuan Town for burial.
