Using Governance to Protect the Mother River -- Written on the occasion of the "World Water Day" and "China Water Week" in 2023

2023-03-22

This year, March 22 is the 31st "World Water Day" and the first day of the 36th "China Water Week". The United Nations has determined that the theme of "World Water Day" in 2023 will be "Accelerating Change", and the Ministry of Water Resources has determined that the theme of China's commemoration of "World Water Day" and "China Water Week" in 2023 will be "Strengthening Water Control by Law and Jointly Protecting the Mother River". People's livelihood is paramount, and water control is essential. Since the 18th National Congress of the Communist Party of China, historic achievements and changes have been made in the governance of major rivers in China. Behind the new appearance of rivers, it is inseparable from the continuous improvement of the legal management ability and level of the water conservancy system and mechanism. Promote the formulation of water regulations, and achieve landmark achievements in the legislative protection of the Mother River. Open the interface of the ecological flow monitoring platform in the Yangtze River basin. On the computer screen, green ecological flow section monitoring points are densely dotted, covering the water system map of the Yangtze River basin. "These data are updated every hour. Once they fall below the ecological flow, the system will immediately give an early warning, and we will promptly investigate the causes and take measures to deal with them." Chen Li, a third level researcher at the Protection Coordination Office of the Yangtze River Water Conservancy Commission of the Ministry of Water Resources, told reporters. Ecological flow is the foundation for maintaining the ecosystem of rivers and lakes, and plays an important role in the ecological protection and restoration of the Yangtze River. As one of the mother rivers of the Chinese nation, for some time, the Yangtze River has been polluted, rivers and lakes have been encroached upon, ecological degradation, wetland shrinkage, and other prominent issues. On March 1, 2021, China's first watershed law, the Yangtze River Protection Law, was officially implemented, marking a new stage in the legal implementation of the Yangtze River protection and governance. In response to issues such as water competition between people and nature in some parts of the Yangtze River basin, difficulties in ensuring ecological flow, and the shrinkage and degradation of river and lake ecosystems, the Yangtze River Protection Law has established an ecological flow protection system for the first time in Chinese law, providing legal support for ecological flow management. In recent years, the Yangtze River Water Conservancy Commission of the Ministry of Water Resources has focused on building an ecological flow guarantee system covering the entire Yangtze River basin, carrying out real-time and dynamic monitoring of ecological flow guarantee work, and addressing issues such as competing with rivers and shrinking rivers and lakes. After the Yangtze River Protection Law has made a "good start" for watershed legislation, there will also be laws to follow to protect the other mother river, the Yellow River. The "Yellow River Protection Law of the People's Republic of China" will go into effect on April 1 this year. Yu Qiyang, Director of the Department of Policies and Regulations of the Ministry of Water Resources, introduced that the formulation of the Yangtze River Protection Law and the Yellow River Protection Law is necessary to promote the development of the Yangtze River Economic Belt, the ecological protection of the Yellow River basin, and the implementation of major national strategies for high-quality development on the track of rule of law. The Yangtze River Protection Law and the Yellow River Protection Law fully absorb the effective practical experience and mature practices in the protection and governance of the Yangtze River and the Yellow River. With water as the core, rivers as the link, and river basins as the foundation, they comprehensively promote the comprehensive management of mountains, forests, fields, lakes, grass, and sand, systematic management, and source control, fully reflecting the correlation between the upstream and downstream, main and tributaries, and left and right banks, in order to promote the development of the Yangtze River Economic Belt The ecological protection and high-quality development of the Yellow River Basin have injected a strong legal force and provided a solid legal guarantee. Strengthen interdepartmental cooperation, achieve significant breakthroughs in the construction of water administrative law enforcement mechanisms. Xu Jin, Deputy Director of the Seventh Procuratorial Department of the Nantong Municipal Procuratorate in Jiangsu Province, is familiar with the case of jointly protecting the Mother River
