Why did a "wild fishing" lead to three procuratorial proposals?

2022-12-09

Recently, I heard that the People's Procuratorate in the northern foot of the Qinling Mountains in Shaanxi Province had sent three procuratorial proposals because of "wild fishing". The reporter of the Rule of Law Daily specially called for confirmation. "It is true!" Huang Zhiping, the chief procurator of the procuratorate at the northern foot of the Qinling Mountains, told reporters by telephone that the three procuratorial proposals were sent to relevant administrative organs in Zhouzhi County and Yuyi District of Xi'an City. "Wild fishing", as the name implies, refers to fishing in natural ditches, rivers, lakes, reservoirs and other places in the wild. Is it making a mountain out of a molehill to issue procuratorial suggestions just because of "wild fishing"? What are the stories behind it? In this regard, the reporter went to the procuratorate at the northern foot of the Qinling Mountains for an interview. A video triggered a public interest lawsuit. At noon on October 24, a video appeared in the fishing social group in Xi'an. The video shows the fishing scene. A man also picked up the fish to show his "achievements" to the camera. "This is Qinling fine scale salmon, a national second-class protected animal!" A careful angler in the group recognized the fish in the man's hand. Immediately, angry fishing friends reported one after another. The public security organ found that the fishing site is located in the Heihe River Water Source and the Heihe River Rare Aquatic Wildlife Nature Reserve in Zhouzhi County. Fishing and hunting are strictly prohibited here. As the procuratorate at the northern foot of the Qinling Mountains is specialized in the jurisdiction of cross regional environmental public interest litigation cases in the northern foot of the Qinling Mountains in Shaanxi, this fishing video was pushed to the second procuratorial department of the procuratorate at the northern foot of the Qinling Mountains after being screened by the big data platform of the procuratorate, attracting the attention of the prosecutors. "The person involved in the video illegally catches many Qinling fine scale salmon, which is suspected of criminal offense. At the same time, we judge from our experience in handling ecological environmental protection cases in recent years that there may be a problem that relevant functional departments fail to perform their duties in Qinling ecological protection." Huang Zhiping was outspoken. Soon, the procuratorial organs took action. While intervening in advance to guide the public security organs to fix criminal evidence in a timely manner, the procuratorate at the northern foot of the Qinling Mountains transferred backbone forces to form a case handling team. In order to master first-hand materials, Huang Zhiping led the case handling team to investigate the protection of fine scaled salmon in the Qinling Mountains along the northern foot of the Qinling Mountains, and focused on Zhouzhi County and Yuyi District where illegal fishing of fine scaled salmon occurred in the past two years. After checking the scene of the case, obtaining evidence materials and visiting relevant administrative authorities, the case handling team started the administrative public interest litigation procedure in accordance with the law in view of the fact that the relevant administrative authorities of Zhouzhi County and Yuyi District did not fully perform their duties of supervising the protection of wild animals such as Qinling fine scale salmon in accordance with the law. Focusing on the difficulties of the case, we earnestly sought to prove that "Qinling fine scale salmon lived in cold water streams 900 meters to 2300 meters above sea level in the Qinling Mountains. Affected by environmental and human factors, they were once on the verge of extinction, and our country listed them as the national second level key protected aquatic wildlife. With the continuous improvement of the ecological environment in the Qinling Mountains, the protection of Qinling fine scale salmon has achieved certain results." Li Haiyan, the prosecutor handling the case, said that the illegal fishing behavior of the two men in the case caused the Qinling fine scale salmon population to face certain risks, the biodiversity function was damaged, and the national interests and social and public interests were violated. The administrative organs need to further improve their ability to perform their duties according to law. The reporter learned that the procuratorate at the northern foot of the Qinling Mountains was established in July this year
