Today, the Supreme People's Court held a press conference to release the "Annual Report on Judicial Review of Commercial Arbitration of the Supreme People's Court (2023)" (hereinafter referred to as the "Annual Report"). The first part of the annual report introduces the new developments in the judicial review of commercial arbitration in China in 2023. In 2023, the Supreme People's Court actively promotes the continuous improvement of arbitration legal rules and deeply participates in the revision of the Arbitration Law; Establish a work exchange and consultation mechanism with the Ministry of Justice to clarify work tasks on key issues such as improving the arbitration judicial supervision mechanism; Publish typical cases of arbitration judicial review, unify the scale of arbitration judicial review, standardize and guide arbitration institutions and arbitrators to handle arbitration cases in accordance with the law; Release the "Guidelines for the Work of the Supreme People's Court's' One Stop 'Diversified International Commercial Dispute Resolution Platform (Trial)" and iteratively upgrade the "One Stop" platform; Strengthen dialogue and exchange with judicial and arbitration institutions of various countries, and promote the construction of China's International Commercial Arbitration Center. Courts in Beijing, Shanghai, Zhuhai and other places have established a notification mechanism for typical cases of arbitration judicial review to standardize the exercise of arbitration judicial review power. The second part is a summary of national arbitration judicial review cases in 2023. In 2023, more than 16000 commercial arbitration judicial review cases will be concluded by courts nationwide. Among them, more than 3800 cases have been concluded to confirm the validity of arbitration agreements, over 10800 cases have been filed to revoke arbitration awards, and 75 cases have been filed to recognize and enforce overseas arbitration awards; More than 1700 cases have been applied for non enforcement of arbitration awards. In addition, more than 5100 arbitration preservation cases have been concluded by courts across the country. The third part is the arbitration judicial review cases and judgment rules for the year 2023. This section has reviewed over 30 cases and summarized the standards for arbitration judicial review and judgment strategies. (New Society)
