The negotiation failed, and Luo filed a lawsuit against Zhou at the Luzhai County People's Court. Luo submitted chat records with Zhou, proving that before purchasing the excavator, he inquired about the product situation from Zhou and made the payment based on this. According to the Consumer Rights Protection Law, business operators shall provide consumers with truthful and comprehensive information regarding the quality, performance, purpose, and expiration date of goods or services, and shall not engage in false or misleading advertising. After hearing the case, the Luzhai County Court made a judgment: the seller committed fraud, and Zhou should refund 10000 yuan of the purchase price to Luo and give three times the compensation. Luo should return the toy excavator sent by Zhou. In daily life, most of the "Little People's Country" products that are not in line with the standards are often low-priced daily necessities. Most consumers often give up their rights due to low product prices and unfamiliarity with the law, which to some extent condones the behavior of unscrupulous merchants. Similar consumer traps continue to emerge, how can consumers protect their rights? Judge Zhou Man of the First Civil Trial Division of the Higher People's Court of Guangxi Zhuang Autonomous Region said that when consumers encounter fraud, they can not only claim a refund or return, but also demand that the merchant pay three times the price of the sold goods as compensation. If the increased compensation amount is less than 500 yuan, it will be compensated at 500 yuan. Consumers should pay attention to collecting and retaining evidence, such as submitting screenshots of online orders, transaction snapshots, chat records with customer service, physical goods, inspection reports, repair documents, etc. What other channels can consumers use to protect their rights besides filing a lawsuit? According to the E-commerce Law, platform operators have the responsibility to strictly review the business qualifications of merchants within the platform, assist government departments in supervision, urge merchants to operate legally and compliantly, and promptly handle consumer complaints. If the platform fails to fulfill its supervisory responsibilities, it may be held accountable by regulatory authorities. If it infringes on consumer rights, it shall bear joint and several liability with the operators within the platform in accordance with the law Qin Bin, Director of the Legal and Theoretical Research Department of the Consumer Rights Protection Committee of Guangxi Zhuang Autonomous Region, said. When operators on e-commerce platforms are suspected of false advertising and infringing on consumers' right to know and fair trade, consumers can negotiate with the operators to request returns or compensation, or call the 12315 or 12345 hotlines to file complaints and report, in order to promptly protect their legitimate rights and interests.
